New Delhi: Before the Lok Sabha elections, Uddhav ( Uddhav) Thackeray has suffered another setback in Maharashtra. Maharashtra Assembly Speaker Rahul Narvekar, while delivering the verdict on the disqualification petitions of Shiv Sena MLAs, said that the Shinde faction in the Assembly is the real Shiv Sena. The Assembly Speaker said that only the party’s constitution presented before the Election Commission will be valid. We asked for a copy of the party’s constitution from the Election Commission. He provided us with a copy of the Constitution that he had. Only this Constitution exists with the Election Commission. The Election Commission also said in its decision that the Constitution amended in 2018 is not present in its records. Therefore, the demand of the Thackeray faction that the amended Constitution of 2018 will be considered valid cannot be accepted.
The Assembly Speaker said that the party never submitted any copy of the Constitution even to the Speaker. Therefore, to decide who is the real party, only the Constitution of 1999 present with the Election Commission will be considered eligible.
The Speaker of Maharashtra Assembly said that Shinde faction is the real Shiv Sena as per the records of Election Commission. Only the information of 2018 available on the website of the Election Commission will be considered as the basis.
The decision of the National Executive is supreme and universally accepted.
Rahul Narvekar said that Mahesh Jethmalani also said in his arguments that the decision of the National Executive of Shiv Sena is supreme and universally accepted. The National Executive meeting was held on 25 June 2022. The resolutions passed in it were accused of making changes fraudulently. They were brought in front of me also. They were signed only by Secretary Vinayak Raut instead of the entire National Executive i.e. the House of Representatives. Rahul Shewale is signing as witness of Arvind who is not even a member of the National Executive. Therefore these documents are under suspicion. They cannot be trusted.
37 MLAs support Shinde faction
The speaker said that Bharat Gogwale was the constitutionally appointed Chief Whip. Shinde faction had the support of 37 MLAs in the House. Let us tell you that undivided Shiv Sena had 55 MLAs in the assembly. After the decision of the Assembly Speaker, there is a fear that Uddhav Thackeray’s MLAs may be disqualified.
It was wrong to expel Eknath Shinde from the party: Assembly Speaker
The Maharashtra Assembly Speaker believes that the Shiv Sena President does not have the power to take decisions but has the power of the national executive. Uddhav Thackeray could not have expelled Eknath Shinde from the party. According to the party’s constitution, the party chief does not have all the powers. They will have to take permission from the National Executive to take decisions. He said that Balasaheb’s will cannot be considered the party’s will. Only Thackeray did not like him, that is why Shinde could not be removed. There is no provision for this in the party’s constitution.
