New Delhi: In a landmark ruling aimed at strengthening pedestrian rights, the Supreme Court has held that the right to walk safely on footpaths is fundamental right of citizens and takes precedence over the use of motor vehicles. The court emphasized that roads are not meant exclusively for vehicles and that the safety of pedestrians must be ensured first.
The observations came while hearing a case related to a tragic road accident in which a five-year-old child was killed after being hit by a speeding vehicle while his father was taking him to school. Reviewing the compensation awarded by lower courts, the Supreme Court directed that enhanced compensation be paid to the bereaved family.
The court noted that the site of the accident lacked both a footpath and a designated pedestrian crossing. It observed that such deficiencies in urban infrastructure contribute to fatal accidents and that governments and concerned agencies have a responsibility to address these shortcomings.
In its ruling, the apex court further stated that citizens whose rights are violated due to the absence of safe footpaths or pedestrian crossings can seek legal remedies and compensation from the authorities responsible.
The bench remarked that human civilization has existed long before the invention of motor vehicles and that the “right to walk” is among the most basic rights, one that stands above the rights associated with cars and motorcycles.
The court also underscored the need for road planning and infrastructure development to prioritize pedestrian safety. The judgment is being viewed as a significant step toward promoting safer urban spaces, improving road safety and reinforcing citizens’ rights across the country.
