Delhi: The Supreme Court will hear ( hearing) on Monday the petitions challenging the constitutional validity of the Waqf (Amendment) Act. A few weeks ago, the government had stayed the implementation of two main points of this controversial law in view of the questions of the Supreme Court.
5 May was fixed as the date of hearing
The Center had informed the court on April 17 that it would not de-notify other Waqf properties including ‘Waqf by User’, nor make any appointments in the Central Waqf Council and Board till May 5, the next date of hearing of the case.
The Center had made this appeal to the court
On behalf of the Center, Solicitor General Tushar Mehta told the bench of Chief Justice Sanjiv Khanna, Justice Sanjay Kumar and Justice KV Vishwanathan that the law passed by Parliament after due deliberation should not be stayed without hearing the government’s side.
The court had given this answer
During the hearing, the Supreme Court said that Waqf properties already registered or declared through notification, including ‘Waqf by User’, will neither be touched nor denotified till the next hearing date.
A bench of three judges will hear
After this, the bench gave the Center a week’s time to file a preliminary reply on the petitions challenging the validity of the law and fixed the next hearing of the case for May 5. A three-judge bench of the Supreme Court will hear five petitions on Monday.
Owaisi has also filed a petition
This group of petitions also includes a petition filed by AIMIM chief and Hyderabad MP Asaduddin Owaisi. The Centre had notified the Waqf (Amendment) Act, 2025 last month after it received President Draupadi Murmu’s assent on April 5.
Bill passed by Lok Sabha and Rajya Sabha
The Waqf (Amendment) Bill was passed by the Lok Sabha with the support of 288 members while 232 MPs were against it. In the Rajya Sabha, 128 members voted in favour and 95 against it. Several political parties, Muslim organisations and NGOs have approached the apex court challenging the validity of the Act.
