New Delhi. The Gujarat High Court can decide today (Friday) whether the sentence awarded to Rahul Gandhi (Rahul Gandhi ) in the defamation case will remain intact or whether he will get relief. Rahul Gandhi had taken refuge in the High Court against the punishment given in the defamation case related to the Modi surname. It is expected that the court will give its verdict at 11 am. According to the list released by the High Court on Thursday, the court of Justice Hemant Prachhak will pronounce the verdict at 11 am on Friday. Staying the conviction will pave the way for Gandhi to be reinstated as a member of Parliament.
Actually this matter is related to a public meeting during the 2019 elections where Rahul Gandhi had commented on the Modi surname. Purnesh Modi of Gujarat had filed a case against him on his statement. He had said that Rahul Gandhi has defamed the people of Modi surname by giving wrong and derogatory speech.
Court refused to grant interim relief
Justice Prachchak, while hearing Rahul Gandhi’s plea in May, refused to grant any interim relief and said he would pass the final order after the summer vacation. Rahul Gandhi’s lawyer argued in the Gujarat High Court during a hearing on April 29 that a maximum sentence of two years for a bailable and non-cognizable offense meant his client could lose his Lok Sabha seat.
Surat court had sentenced him to 2 years in jail.
Surat’s Metropolitan Magistrate court on March 23 convicted Rahul Gandhi under sections 499 and 500 (criminal defamation) of the Indian Penal Code (IPC) in a 2019 case filed by Bharatiya Janata Party (BJP) MLA Purnesh Modi in Gujarat. Was sentenced to two years in prison. Following the verdict, Gandhi was disqualified from membership of Parliament under the provisions of the Representation of the People Act. Rahul Gandhi was elected to the Lok Sabha in 2019 from Wayanad in Kerala.
