Amritpal Singh: Amritpal ( Amritpal,) Singh is once again in the news. A new announcement by Khalistan supporter and supremo of ‘Waris Punjab De’ organization Amritpal Singh has come to light. It was told that he is going to contest the Lok Sabha elections as an independent candidate from Punjab. Amritpal’s lawyer, after meeting him, has announced that he will contest the elections. NSA has been imposed on Amritpal and currently he is lodged in Dibrugarh jail of Assam. After this announcement from Amritpal, many questions are coming in the minds of people.
Actually the question is whether a person who has been charged with a law like NSA and is in jail, can he contest elections? It is important to understand this. There is talk that Amritpal can contest elections as an independent candidate from Khadur Sahib seat of Punjab. Although there are many cases registered against Amritpal, but after the registration of NSA, he remains a topic of discussion in the media across the country.
Can the person on whom NSA is charged contest the elections?
Article 84-A of the Indian Constitution gives detailed information about who is eligible to contest elections. On the other hand, National Security Act-1980, i.e. NSA or NSA, is a law related to giving more power to the government for the security of the country, which orders the central and state government to arrest anyone. Is there any connection between these two that the person who has been booked under NSA cannot contest elections? The answer to this is no. That means he can contest elections.
Exemption from contesting elections..
In this case also the same thing comes to the fore that according to section 62(5) of the RP Act of 2013, one can get exemption from contesting elections from jail, that is, any prisoner can contest elections. In this way even a Rasuka person can contest elections. Anyway, the provision of Rasuka is that if the government feels that someone is a threat to the security of the country, then the government has the power to arrest him under this law. This means that initially he has not been convicted. In such a situation, he can definitely contest elections from jail.
Locked in Dibrugarh jail..
At present Amritpal is in the news. In February last year, people associated with Amritpal’s organization ‘Waris Punjab De’ had created a ruckus at Ajnala police station. When the uproar increased, the government started taking action. Many of Amritpal’s associates were arrested but he escaped and kept challenging the government, NSA was imposed on him and he was arrested within some time. Presently he is lodged in Dibrugarh jail of Assam.
