Three independent MLAs changed sides( MLAs )

New Delhi: The threat to the BJP government has increased in Haryana. 2 independent MLAs  ( MLAs ) have withdrawn support from Naib Singh government. There are currently 88 MLAs in the 90-member Haryana Assembly. The required figure for majority is 45. BJP has 40 MLAs. He had the support of 6 independent MLAs, however, due to the separation of 3 MLAs from the government, the number of pro-BJP MLAs is now only 44. In such a situation, the Congress party has strongly attacked the government. From the Congress side it has been said that Naib Singh should resign from the post and President’s rule should be imposed in the state.
Former Haryana Chief Minister Bhupinder Singh Hooda said that “Independent MLAs have withdrawn their support from the BJP government and have decided to support the Congress. They have taken this decision as per the public sentiments… The moral authority of the government has ended.” Yes, he (Nayab Singh Saini) should step down and resign and President’s rule should be imposed here so that fair elections can be held…”
Three independent MLAs changed sides
Three independent MLAs on Tuesday announced that they have withdrawn their support to the Nayab Singh Saini-led government in the state. The three MLAs – Sombir Sangwan, Randhir Golan and Dharampal Gonder – also said that they have decided to support the Congress during the elections. The three MLAs met in Rohtak in the presence of former Haryana Chief Minister Bhupinder Singh Hooda and state Congress chief Uday Bhan. This was announced in the press conference held.

There is no threat to Naib Singh’s government
Despite being in minority, there is no threat to Naib Singh’s government of Haryana. No government is considered to be in minority until it is defeated in a no-confidence motion in the House. In such a situation, withdrawal of support by independent MLAs in the media does not prove that the government is in minority. For this, opposition parties will have to bring a no-confidence motion in the House. A no-confidence motion was brought in the Haryana Assembly by the Congress Party in the month of March. In such a situation, technically a no-confidence motion cannot be brought against the government in the Assembly.
There must be a gap of at least 180 days between two no-confidence motions. This means that the next no-confidence motion against the BJP government in Haryana cannot be brought within the next 6 months. Under the no-confidence motion brought in March, now the next no-confidence motion can be brought only in the month of September.

What are the options before Congress?
No-confidence motion cannot be brought by the opposition parties yet. However, Congress and other opposition parties can request the Governor for this. At the behest of the Governor, the Chief Minister may have to prove his majority.

For the first time in the history of Indian Parliament, in August 1963, J.B. Kripalani had moved a no-confidence motion. Then only 62 votes were cast in favor of this proposal put forward against the government of the then Prime Minister Jawaharlal Nehru and 347 votes were cast against it.
What is no-confidence motion according to the constitution?
The essence of no-confidence motion is contained in Article 75 of the Constitution of India. Any member can present a no-confidence motion against the Council of Ministers. To do this, he has to give a written notice to the Speaker of the House. If the no-confidence motion is passed, the entire Council of Ministers has to resign.

How did the crisis come to Haryana government?
Haryana has witnessed huge turmoil in recent times. Just before the Lok Sabha elections, BJP made Naib Singh the CM of the state in place of Manohar Lal Khattar. Meanwhile, the alliance of state BJP and JJP also broke. JJP has 10 MLAs in the state. However, the BJP government was saved due to the support of 6 independent MLAs. Now once again after the rebellion of independent MLAs, the government seems to be lacking majority. However, according to constitutional rules, no-confidence motion cannot be brought against Naib Singh’s government.

On support of Congress by some independent MLAs, Haryana Chief Minister Nayab Singh Saini has said that MLAs have some desires, Congress is currently busy in fulfilling their desires. People all know what someone wants. Congress is not concerned with the wishes of the people.

Elections are going to be held in Haryana later this year. Elections can be announced by the Election Commission in the months of September and October. In such a situation, there is no possibility of Naib Singh’s government coming into minority. However, the Congress Party is demanding resignation from the state government on moral grounds.
