New Delhi. Parliament has approved the ‘Digital Personal Data Protection Bill-2023’ with provisions to determine the accountability of data security.(security) In this bill passed by voice vote in Rajya Sabha on Wednesday, provision has been made to impose general and in some cases special obligation on the bodies involved in the protection and promotion of digital personal data. This bill has been passed in the Lok Sabha on 7th August. In such a situation, after getting the approval of President Draupadi Murmu, this bill will take the form of law.
Communications and Information Technology Minister Ashwini Vaishnav said that in the last 9 years, Prime Minister Narendra Modi has delivered essential services through digital medium and it is being discussed all over the world. He said that everyone has seen the importance of digital transactions and it has become the need of our lives. He said, ‘900 million Indians have connected to the Internet and digital facilities have reached even the smallest village. In such a situation, the security of digital data is very important, in view of which this bill has been brought.
He said that appropriate provisions have been made for data security in this bill. He said that whatever data will be collected, according to the law, it will be used for the specified work, the data will have to be deleted after use, all measures will be taken to keep the data private and it will be the responsibility of the data collector. That it will protect the data in accordance with the law.
How Data Protection Law Affects You
The Minister of Communications and Information Technology said that the data of any person, data coming on any platform or app will now come under the law. It has been said that this data should be used for the purpose for which it is taken.
He told that a provision has been made in this that only as much data as is required should be taken and if there is a change in the personal data of a person, it should be followed accordingly. The purpose of the bill said that the data should be kept for as long as it should be kept.
Vaishnav said that through this the accountability of data security has been fixed. He said that people who are reluctant to put data on social media will have the right to decide on it. The Union Minister said that a data protection board will be formed which will look after the entire system related to data. He said that there will be experts in the board and the board will work through the law and will be independent.
Vaishnav said that this is the first bill in which full respect has been given to women power and in this ‘She’ has been used instead of ‘He’. It has been prepared in very simple language.
Highlights of the Data Security Bill…
The central government will have the power to stop and restrict data transfer to any country outside India.
Social media companies using user data will have to protect users’ personal data, even if it is accessing data using third party data processors.
The data of children and the data of physically disabled people can be accessed only after the permission of their guardian.
In case of data breach or data theft, companies will have to inform the Data Protection Board and users.
Appeals against the decisions of the Board will be heard by the Telecom Disputes Settlement and Appellate Tribunal.
The board can investigate companies and can also examine their books of accounts and documents.
DPB can also impose fine on social media firms after deep investigation.
If a company violates this law more than twice, then the company’s access to any intermediary can be blocked.
Social media companies will have to appoint a data protection officer and users will also have to be informed about it.
Companies can also be fined up to Rs 250 crore for data breach, not being able to protect personal data or not informing the board and users about this breach.
